NYC benchmarking deadlines: the next penalty date is November 1, 2026
Updated October 16, 2026. Dates and quotes are from the NYC Department of Buildings pages linked at the bottom.
The yearly deadline
Local Law 84 requires every building on the City's Covered Buildings List to report its energy and water use for the previous calendar year through ENERGY STAR Portfolio Manager. The DOB's benchmarking page says: The benchmarking deadline for data from calendar year 2025 is: May 1st, 2026.
The same page asks owners to share the property with the City at least 15 business days prior to the May 1 deadline.
The quarterly dates that matter after you miss it
The DOB page continues: Subsequent deadlines are August 1, November 1, and February 1 of the following year.
These are the dates the City uses for follow-up violations. The DOB's violations page states the penalty: Failure to benchmark may result in a penalty of $500, issued on a quarterly basis until the benchmarking report is submitted, totaling up to $2000 per year.
| Date | What it is |
|---|---|
| May 1, 2026 | Deadline for the calendar-year 2025 report (passed) |
| August 1, 2026 | First quarterly follow-up date (passed; the City issued a large batch of violations on September 25, 2026) |
| November 1, 2026 | Next quarterly date. A building that still has no report in can receive another $500 violation. |
| February 1, 2027 | Last quarterly date for the 2025 report |
| May 1, 2027 | Deadline for the calendar-year 2026 report (a new cycle starts) |
The quarterly $500 rule is written for buildings that have not submitted a report. For a report that was submitted and rejected for data quality, the DOB's violations page says: The Department may issue a Notice of Violation to any building on the Covered Buildings List that has not provided a fully compliant benchmarking report by the May 1 deadline.
We have not found a City rule giving a separate penalty date for rejected reports, and we do not claim one.
What "submitted" means
A report counts when the property is shared with the City in Portfolio Manager and passes the City's data checks. Data moves from Portfolio Manager to the City nightly, so a report finished on October 31 is cutting it close, and a report with an error (wrong BBL or BIN, a meter left out, property type "Other") may not count at all. The City's own advice is to finish 15 business days early.
What to do this month
- Check your building (free). Our checker reads the City's Covered Buildings List, the public violation record and the last public filing for your address.
- If the building never filed: set up the property in Portfolio Manager, collect a full year of whole-building energy data from the utility, enter the BBL and BIN, and share with NYC. The City's step-by-step list is on the DOB page below.
- If the report was rejected: read the City's error email, fix the setting or the missing data in Portfolio Manager, and make sure the property is still shared. See rejected LL84 report: how to fix it.
- If you already have a violation: see what to do about an LL84 violation (paying and challenging are both done in DOB NOW).
If you would rather hand it off
NYC Benchmark Filing is a private company, not the City. We prepare and file a never-filed report for a flat $495, or fix and resubmit a rejected one for a flat $349. New filings depend on utility data, which can take days to weeks to arrive, so the sooner you start before November 1 the better. We cannot promise the City's timing or decisions, only our work.
