Terms of Service
Effective October 14, 2026 (updated October 15, 2026: switching price)
These terms apply when you order a service from NYC Benchmark Filing ("we", "us") through nycbenchmarkfiling.com or by email. By placing an order you agree to them. Questions: office@nycbenchmarkfiling.com.
What we do
We prepare, correct and submit New York City Local Law 84 energy and water benchmarking reports for buildings, using ENERGY STAR Portfolio Manager and the City's BEAM portal. We are a private company. We are not part of, or affiliated with, the NYC Department of Buildings or any government agency. We are not a law firm or an engineering firm and do not give legal or engineering advice.
Prices and payment
- Our prices are flat fees per building, shown on our website at the time you order: $495 to prepare and file a report for a building that never filed (also for rejected reports that need missing utility data collected or a multi-building setup rebuilt), and $349 to fix and resubmit a report the City rejected. Orders placed before October 14, 2026 keep the price shown on their invoice.
- Switching from another provider: if the building filed its LL84 report last year (it appears in the City's public LL84 data for the most recent year the City has published), there is no first-year fee: you start straight on the annual plan below at $249 per year. We check the City's records when you order; if the building does not qualify, we show you the right price before anything is charged.
- If you choose "Not sure", we confirm the service and price by email before any work begins.
- Payment is due when you order or when we send your invoice. Card payments are processed by Stripe. We do not see or store your card number.
- City filing fees or penalties, if any, are not included and are paid by you directly to the City.
Annual plan (optional, automatic renewal)
- What it is: for $249 per building per year, we prepare and file the building's yearly LL84 benchmarking report before the City's May 1 deadline, every year while the plan is active. It covers one report per year for one building, as long as we receive the information we ask for (for example a confirmation that nothing changed, or new utility account numbers) in time.
- Switch plan: the switching price above is this same annual plan, with the same billing, renewal and cancellation terms.
- Billing: you are charged $249 by card when you sign up. That payment covers the next yearly report. The plan then renews automatically every 12 months at the same price, charged to the same card, until you cancel. We email you a reminder about 30 days before each renewal. We will tell you at least 30 days in advance if the price ever changes.
- Cancel anytime: use the billing link in your Stripe receipt or in the client portal, or email us. Canceling stops all future charges. If you cancel before we start work on that year's report, we refund that year's charge in full.
What we need from you
- Accurate information about the building, such as utility bills or account numbers, floor area and number of units.
- Access to the building in Portfolio Manager and the BEAM portal, or permission to set these up for you.
- Confirmation that you are the owner or are authorized by the owner to order this service.
We rely on the information you, your utilities and the City provide. We are not responsible for errors in that information, but we will tell you if something looks wrong.
Timing
We reply to every order within 1 business day. Easy fixes are usually completed within a few business days after we receive access. Full filings depend on how quickly utility data can be collected. We will tell you if something will take longer.
What we cannot promise
The City decides whether a report is accepted and whether violations or penalties are issued, reduced or dismissed. We do not guarantee any City decision. Filing or fixing a report stops new benchmarking violations from being issued for that report, but violations already issued usually remain. We do not guarantee that any penalty will be removed or refunded.
Free redo and refunds
If the City rejects a report we submitted because of our mistake, we fix and resubmit it at no charge. Refunds are explained in our Refund Policy.
Liability
To the extent the law allows, our total liability for any claim related to a service is limited to the amount you paid us for that service. We are not liable for indirect losses, or for penalties or fees charged by the City.
Privacy
How we handle your information is explained in our Privacy Policy.
General
These terms are governed by the laws of the State of New York. We may update these terms; the version on this page at the time of your order applies to that order.
